Probably the best advice you can get. Hopefully she didn't drive off in the car but somehow I think she has?

Provided its on the signed and agreed specification i.e. On the receipt or similar, then you have a perfect case.

If however it was an off hand remark (Word of mouth) from the sales man or something written in a standard brochure (Specification in different markets can greatly vary) then you don't have much to stand on other than 'good faith' from the garage.

Does she have it in writing somewhere?

  • Registered Users, Registered Users 2 Posts: 76 ✭✭hession

No she didn't have it in writing as she was going for a 132 but there wasn't much in the difference and it had alloys and he did say the 141would be the exact same but she could choose the colour and the alloy. She now has the car and the sales guy said their was never anything said about alloys very bad salesman ship I think .

Unless its in writing then you don't have much to go by. Its a 'what he said, what I said' situation' The Yaris (And I own one so this isn't slander) is generally brought into the country with really low spec. Its very difficult to get a high spec model and any that are, are usually UK imports. Alloys are a luxury here while in the UK its pretty standard. Same can be said about fogs.

I'd review everything you have in writing i.e. Receipts, sales docs etc and see does it mention alloys. If not, I'd go back and have a decent chat. Explain your concerns to the general manager. Sadly without anything in writing the garage have done nothing wrong that can be proven.

+1 .. if alloys were part of the order (and presumably price) then that's what should have been delivered.

I would have refused to accept delivery myself until it was sorted. I'm sure they would have had another one there they could have swapped the wheels from, or given her a discount on the price/extended warranty/free servicing etc.

Why did she drive off without getting what she paid for?

Reject it as not what the deal was. Just be careful about whatever financing she may already have signed up to. Good case in London today about a lad who rejected a laptop as it didnt have the features promised, his credit score was screwed when he defaulted on the finance even though he didnt have the machine, and it took years to sort out. The Court case is him suing the finance company for affecting his ability to carry on his life.

It's easy say now but her best bet would have been to refuse to accept the car as delivered. I'd imagine her come-back is now lessened by taking the car. I really dunno what she can do now apart from relying on the better nature of the garage in question and talking to them.
Is she certain the alloys were actually included? A lot of the specs are standard i.e. Terra, Luna, Aura in Toyota. Not sure which one has alloys as standard, I'd imagine it's only the dearest one which is the Aura I'd say.
Was there possibly some deal going on the 132 with Alloys thrown in, but in the decision to go with 141 perhaps the Alloys no longer applied? That's what it sounds like to me, and it wasn't communicated properly to her.

With the avensis its only terra which is the lowest spec that hasn't alloys, aura strata and luna have but the yaris may differ.

Find it hard to believe that you could choose what alloys you get. Most untoyotalike.

Yaris aura and sol have alloys, Terra and Luna don't.

Did she pay for the alloys as an extra?

Weren't they doing a 'sport' model last year. I reckon they might have changed the trim levels? What does the order form say for a trim level?

That's what I think too. It's most likely a crossing of wires rather than any deliberate attempt to do the OP out of alloys.

From memory they were rotten black alloys that looked like Aldi wheel trims

    Edit:

They look so much worse in the flesh

You're on the money here Colm, the sport model was pushed largely for 132's
The only time you are given an option of which alloy you want is when you buy them as an extra, but with the sol or the sport you don't get a choice of alloy. Sounds like wires got crossed in the conversation...
