Had Crash this morning

    Hi just a bit of advice please. Was driving back from dropping my little lad to creche this morning. Driving round this country lane just a bit from my house, where you have to take it really slowly, saw this car coming in oposite direction travelling too fast she slammed on the breaks and skidded straight lnto me . Nobody hurt .thank god, I got out of the car and said too her i can't believe you were going that fast .she says sorry, i was shuk up she looked same so. I walked back too my car phoned guards they took details, i asked guards what happens now he more or less said sort it out yourselves, when i got home i rang her and said I'm just letting you know I'm making a claim on your insurance , she said it can't be helped. I rang them and they said we'll ask her , her version , I've got an awful feeling she's not going to admit she was in the wrong. Sorry for long post still abit shaken, anyone any advice thanks

    If it's a lane with no white lines it end up being knock for knock...had similar incident in past guy speeding in van I stopped he skidded into me. When filing in your accident report be sure to mention that she admitted responsibility. She could of course change her mind say it was your fault, that's when your insurance company could decide to treat it as knock for knock, ie you got her as good as she got you....crap situation I know but at least nobody hurt and your little lad not in car

    If you are stopped even in the middle of the road and a you get hit it is the car that's moving is at fault.

    Roads without lanes are a disaster, the guards won't take sides on this so unless there were witnesses your in trouble.

    Passed an accident that looked exactly the same as this near Ballynaboola this morning. Skinny little road with barely enough room for two cars to pass. No one looked injured, but the cars where a wreck!

    I guess the important thing here is IF the Guards heard her saying she's sorry or that she's in the wrong. What makes me doubt that this woman's husband is a lawyer is the fact she apologised on the scene of the accident. Claims 101 dictates you do NOT apologise or admit guilt even if it's CLEARLY your fault. I've seen claims spin around on that point alone.

    Garda cannot decide who was at fault. The insurer investigates, doesn't matter what Garda says in any case. Good luck OP.

    Doesnt make a blind bit of difference what you say or admit to at the scene. All you have to say was that you were in shock and not thinking clearly and none of it can be taken into account.

    Especially without independent witnesses. Independent witnesses and photos are good to have. Or be dealing with an honest decent person. Although id imagine the actual "at fault" party statistically tends to self centred A-holes without regard for other people and their property and more likely to try to lie their way out...

    Devils advocate was the term I was thinking of. The op should hope forfor the best but expect the worst, grainnewhales scenarios are not all that unlikely

    Would a passengers statement count for much? Theyre not exactly an independant witness (unless its a taxi or something like that).
