Small claims or kraky mammy

    Hi well last may I have my daughters gHD to a repair company.
    I honestly have a pain in my face asking for it back.i rang ,I called in I was told they would post it out to me , then it was gone to a storage place in navan.
    I did want it for her birthday in June .now December is here and when I ring i go over the whole story again because Alan isn't in.
    Will I give up ,should I go to small claims something that actually would scare the life out of me.
    I tried been nice. , should I ring up and be kraky ?
    Any advise ?? Thanks

    I'm not a solicitor, but it sounds like a perfect case for Small Claims Court, which is very straight forward and not scary. You fill in the form, pay the €25 (?). The repair company will at that stage either sort you out before it goes to court, or go in and make some excuses. You don't need a solicitor or anything.
    Presuming you've already paid for the work, send the company a registered letter tomorrow telling them they've got 5 working days to send you back a working GHD, or you'll be going to the SCC. If it doesn't turn up, fill in the forms. Don't bother with any more phone calls if they're just annoying you. Ask a friend to review the form before you send it in.

    The Small Claims process involves, at worst (initially at least), an informal meeting and cup of tea with you, the defendant party and the registrar. Absolutely nothing to be afraid of. It's not a court as such but a process.

    Ok janey mac I just sent them an email letting them know I will pursue to the small claims court.
    I hope they don't , I have anything like this, but shes burnt her hand twice on the one I got her to replace the GHD, while shes waiting.

    Email is no good Cathy. Too easy to ignore. Write it out and send it registered post. You need the paper trail if it goes the small claims route.
