How long must you be employed before being covered by employment legislation?

    Hi, quick question. Just wondering how long a person must be employed in order to be covered by employment laws concerning a wages claim?

    was working through an agency and the company kept incorrectly signing off on my hours worked. They said I worked less hours then I did. I can prove the hours I worked but was only there for a few weeks, would I have grounds to bring a claim for wages if I was there for less then 12 weeks?

    Agency have asked employer to sign off but they have refused saying I didn't work the hours, it's all a bit messy.

    If the company didn't keep correct and accurate records of my hours worked, not getting breaks etc am I able to make a complaint to get paid for the hours i worked against the company and not the agency? Especially since I can prove I worked the hours :confused::confused::confused:

    It's not really employment legislation as such, your issue can be dealt with under contract law simpliciter. I think you're thinking of the year before you can avail of EAT?

    Honestly I'm not sure tbh. Just wanted to check that if I can't get the issue resolved would I have grounds to refer to a rights commissioner for non payment of wages or not keeping accurate records of the hours worked. failure to ensure adequate rest periods etc. I knew about the year for the EAT, just wasn't sure if there was a minimum length of time involved for other complaints.

    Had issues in the place from the get go so found somewhere better, very annoyed that now the manager is not paying me for all the hours worked.

    If they won't sign off on them then the agency say they can't/won't pay. Just very annoying tbh. Wondering what recourse if any might be available to me, I just wish to be paid for the hours I worked
