it's a bottle of water, sugar and acid. the stuff'll survive a nuke, let alone a winter.

And depending on best before/use by may be illegal to sell

  • Closed Accounts Posts: 9,396 ✭✭✭Frosty McSnowballs

Ok, just never heard that term before.

  • Registered Users, Registered Users 2 Posts: 456 ✭✭brian_gall85

Not illegal so long as it's clearly marked to clear.

If it's use by rather than best before then it is illegal to sell!

they are clearly marked 'short dated' and 'priced to clear'

It is a best before date not a use date. They are made with artificial sweetner, carbon dioxide(thats what the fizz is) and phosphoric acid. Both phosphoric acid and C02 are preservatives. If if had sugar i.e regular coke because, guess what you got it thats a preservative too. Only wish I lived in there, then again it is a good while since I visited Top In Pops. :D

Short dated means they're close to their best before, but still in date.

These are past that, so illegal to sell

Illegal, where is the stated law or are you quoting opinion as fact?

    Taken from fsai.ie
    Q. Is it illegal to sell food beyond its best-before date?

No. There is nothing in legislation that prevents a packaged foodstuff being offered for sale on or after its ‘best-before’ date provided that the foodstuff is still in a fully acceptable condition. However, if the out-of-date stock is to be sold to the consumer, it is strongly recommended to indicate to the consumer that the foodstuffs are past their ‘best-before’ date. This will assist in ensuring that the consumer is not misled as to the true nature of the product which is an offence.

    Q. Is it illegal to sell food beyond its use-by date?

Foodstuffs with a ‘use-by’ date should not be offered for sale after this date due to the possible deterioration of these highly perishable products and the associated risk of illness if they are consumed. Regulation 852/2004/EC on the hygiene of foodstuffs (transposed by European Communities (Hygiene of Foodstuffs) Regulations, 2006 (S.I. No. 369 of 2006) states that the primary responsibility for food safety rests with the food business operator. In addition, Regulation 178/2002/EC states that food must not be placed on the market if it is unsafe. Unsafe food is defined as being a) injurious to health b) unfit for human consumption. Selling a food past its ‘use-by’ date, when it is potentially unsafe, would be in breach of legislation.

It's law to put a bb date on produce, doesn't mean it's not good to eat or drink past that date, the Use By date is more important than a BB date.
There's even a campaign now to clarify this on packaging to stop food waste,my missus is a divil for throwing out perfectly good food.

You can bet if it was 24 bottles of beer for a fiver nobody here would complain.

If you can show me a law in Ireland that backs up your statement that it is illegal to sell something after the best before date, I will eat my hat and pay you enough to buy coke zero for the rest of your life.

    I don't lose bets!

What I took from what he was saying is not that its illegal to sell something past its best before date, but that it is illegal to sell something as 'short dated' when it is in fact well past its best before date - 'short dated' referring to it approaching the best before date rather than already being well past it.

It's still misrepresentation, which is illegal.

How is it misrepresentation if the correct date is stamped on them?

The sign saying, and I am paraphrasing here - Cheap Coke, short dated - is the misrepresentation.

Correct dates are specified so their is no misrepresentation. Is it really that hard to admit you were wrong ;)

Its false advertising then. Short dated means there is still time before the product goes out of date. Seeing as the product is already out of the date, the advertising it totally misleading.

Its a bit worrying that people might think coke would possibly have a use by date, i.e. thinking it suddenly will become toxic at the stroke of midnight or something.

I have seen lads discussing drinking beer 10 years past its BB in the beer forum, said it had just gone a little flat.

When they calculate the BB date to put on items it is usually a year or more away, they have to err on the side of caution and so presume it could be in pretty poor conditions, e.g. in direct sunlight etc. Also producers like coke often change their packaging quite often, so I presume many of the BB dates can be a way to force retailers to rotate stock, which is otherwise perfectly fine.

I had a bottle of Erdinger Kristall and Paulaner Octoberfest brew from last year that I opened in September (it was in the fridge that whole time) and it tasted rancid. Im not used to Kristall but I had drank a load of those Octoberfest Paulaners and they were definetly off. They smelt and tasted awful.

stating that Advertising something as 'short-dated' when it is past date is illegal is not wrong, regardless of whether or not the product can survive a nuclear winter.

If something is marked as 'Short Dated' it invites the purchaser to inspect the BB date, which should be clearly marked, is not misleading anybody
