Sold Car Need Help problem

    Hi i sold an audi a4 there last week in perfect condition with lots of receipts to prove , and received a text from buyer this morning saying "there is something wrong with engine,it needs some parts as its too smokey, if my mechanic says its engine , im bringing it back to you !!!! "

    Where do i go from here lads as i sold that car in A1 condition ??

    Caveat Emptor. Not your problem unless you knowingly sold the car with issues that made it unsafe.

    You sold the car as is.... nothing they can do this is the chancr of buying second hand cars off private people cars go wrong all the time..... tough luck lads tell them fob off

    No you do not.

    The LAW is on your side. As others said caveat emptor "let the buyer beware", unless you knowingly sold a junker then you have no issues and they have no comeback. You are a private seller not a dealer.

    Do not answer the text or phone calls. You should have got a throwaway phone as well so they couldn't keep annoying you on your personal phone.

    I think if it was me I would just text back and say what you stated above that when the car left your hands it was in perfect condition with lots of receipts to prove and your aren't responsible for anything that transpired after it left your care.

    No you do not.

    The LAW is on your side. As others said caveat emptor "let the buyer beware", unless you knowingly sold a junker then you have no issues and they have no comeback. You are a private seller not a dealer.

    Do not answer the text or phone calls. You should have got a throwaway phone as well so they couldn't keep annoying you on your personal phone.


    Thanks lads , i had receipts costing nearly upto 1000k prior to sale , not one bit of smoke came out when i had it ,

    If it was me, I think I would simple say something like, "I have been completely honest with you so I don't appreciate your accusation. Please dont contact me again" and just ignore if they contact you again since you have done your part to explain.

    Tell them, not to accuse you of lying and any more phone calls you'll contact the gardai for harrassment.

    Get their solicitor to ring your solicitor....

    +1 tell them to sue you for their money back. A week is a long time to kill an engine. Once you sold it in good condition theirs nothing they can do.

    If they contact you again tell them to direct all correspondence true their solicitor, if they make contact with you again you'll report them to the Gardaì for harassment.

    Make sure to keep all texts from them and, if possible, record telephone conversations in case they become abusive and threatening, which you can pass to the Garda if needs be.

    Unless of course OP is a dealer posing as a private seller with multiple ads for cars on all the cheaper advertising spaces ....

    "i sold an audi a4" is a strange phrase for a private seller who would be more likely to say "i sold my audi a4"

    Send them one more message and tell them that you have reported the matter to the Gardai as you feel they are being threatening and that if they wish to contact you again to write to your solicitor and give them a solicitors address (or make one up as they won't go down that route anyway) then ignore their calls/texts.

    Don't reply to the text other than to say that the car was sold as seen with no known issued at time of sale. Any issues since is his responsibility.

    Thats true, so tell them that they are being recorded and that all future calls from them will be recorded and that any forms of abuse or threats will be fowarded to the Gardai.

    I suspect they are hoping to get some money out of you for "repairs" and will probably stop trying if you ignore them

    If there was not misrepresentation of the car in advertising or spoken word then you should be ok. However if you knowing sold them a clunker or mislead them in sale then you are exposed.

    If someone has the cheek to sell a clunker they'll already know that in the end there's very little the purchaser can do. It's a civil matter so getting a judgement doesn't mean getting any money, without a lot more cost for the purchaser, if the seller doesn't pay up.

    Buying privately totally relies on the honesty of the seller, as if anything goes wrong it's time consuming and costly to get justice if they aren't honest to begin with.
