Query with regards to bail conditions - good behavior clause

    Hey all,

    General knowledge questions... not in legal profession.

    When it comes to good behavior condition on bail how is that defined & when is it breached? e.g. when are bail monies lost? If you are arrested on something? If you are charged with something? If you admit to something? If you are convicted of something?

    also if people know what section of what act is applicable to this breech too it'd be appreciated. I'd assume bail act?

    my understanding is that when you take up bail:

    money is handed over under various conditions:

    - obey the law
    - not to break the agreement
    - sometimes to agree to a curfew (9am-9pm)
    - sign on at local garda station on agreed days/times
    - reside at specified address.
    - not to reapply for a passport/travel documents etc

    so… coming to the attention of the gardai …. could be as simple as hanging around on a street corner with friends (outside of curfew hours), the gardai may well overlook it but if they wanted to nail someone for breaching conditions … all they would need to do is say he/she breached court orders/agreements in their terms of bail …and suspect is put back into custody.

    in a real world situation a garda might wait until next court date to say that the suspect was found in breach of bail conditions on X amount of times - just as evidence showing the court that the suspect shows little respect for the courts - the judge can read between the lines that if the gardai accidentally find someone in breach of bail conditions - the person has no respect for the law and doesn't want the court to show leniency.
