Parkrite Dispute.

    Sorry, second motoring mishap thread by me in a week.

    So, around two weeks ago, we recieve a letter in the post saying that due to not paying our original parking pine (€40) within the 28 day period, the fine had increased.

    we thought this very unusual because we never got a ticket on the car, ever. nor never got an initial letter of any sort in the post either.

    so we went to our local council office who issued the fine to see what the story was. turns out they had a photo of the car from the rear, parked with 2 wheels up on the footpath with the engine on (steam from exhaust visible) and my mother inside. my mother remembers the situation and said there was never a ticked put on the car, nor does she remember ever seeing the parking inspector. now, as the car was "parked" somewhat inconsiderately, we have no real issue with paying the basic fine given the circumstance.

    We wrote to parkrite explaining the above and they replied the are adamant we should be paying "non payment fines" and all sorts. is it true that they don't need to actually give you a physical slip of paper anymore and that they can just photograph you and that is enough?

    do we have a leg to stand on to dispute to just pay the original fee? what would happen if we just never pay?

    It seems to me that your two choices are to appeal it or to fight it in court. Are they claiming to have left a ticket on the car and/or sent you a bill? How much do they want now?

    thats the thing. will it ever go to court?

    no, they are saying that a photo taken by the inspector is enough to "convict" us and that we have to pay the late fees. which is very inconsistent because how would we/ anyone be able to avoid late fees if we never receive an initial fine. the fee's are now €60 or €80 i can't remember. not the fine of the century but the principle of the matter is much more important.

    You can be sure of it if you don't pay or appeal a council ticket.
    no, they are saying that a photo taken by the inspector is enough to "convict" us and that we have to pay the late fees. which is very inconsistent because how would we/ anyone be able to avoid late fees if we never receive an initial fine. the fee's are now €60 or €80 i can't remember. not the fine of the century but the principle of the matter is much more important.
    I think what it really comes down to is telling the judge and hoping that (s)he believes you. It might work, but it might get you a bigger fine and you're down the time too.
    I take it you've already appealed it and had your appeal turned down? If it's any help, that happened to me with DLRCOCO and I appealed the appeal and won.

    Parkrite are a private company, how are they involved? Are they sub-contracted by the county council (unusual)?

    Local council issued the fine. It is in post 1 line 4.

    AFAIK the councils are subcontracting out parking services more and more. Dún Laoghaire Rathdown use APCOA, for example.
