Shared Entrance

    Hi all,

    I have a question about a shared entrance between me & my neighbour,

    my neighbour is planning on building entrance walls & piers etc which will be entirely on his property only,

    to access my property from the road I have to enter his gates and then turn into my driveway as the lane is split in a Y shape,

    this is all fine but the question I have is if my neighbour doesn't build it 100% to regulations could it have an effect on my property if I decided one day to sell?

    if something is not built according to regs, then the owner(s) are liable. accordingly, if you share ownership then you are jointly responsible whether you built it or not. but instead of worrying about it, why dont you ask your neighbour what they plan to do. maybe it will be within the exempted limits.
    strickly speaking, an unauthorised developement should be noticed by any solicitor acting for either party. a solicitor who picks it up will bring it to the purchasers attention. alot of "ifs" when you probably have nothing to worry about.

    Thanks for the reply,

    the thing is though that I don't share ownership with my neighbour, I just have the right to use his entrance to access my driveway,

    this was agreed at the time the two houses were built about 8 years ago, It's all on his property.

    in theory, yes

    Ray, it sound like you need a local eng/arch who has access to the planning files and folio maps to review and ensure your fears are not realised

    I tried getting in contact with the arch who done my drawings etc but no luck so I rang my solictor who looked after the paperwork back then and they told me that its a right of way rather than a shared entrance, sorry about that!

    and that any work carried out by my neighbour would have no affect on me as its not on my property,

    some peace of mind at least,
