Retention Permission clarification

    Hi All,

    Myself and my other half are looking to buy a house. Estate agent sent us on a notice that the vendor is putting in the papers next week. Extract as follows - "...intend to apply for Retention Permission, of dwelling and dwelling position, revised site boundaries, site entrance and septic tank and effluent treatment system to those shown in Planning Ref..." Do I take that to mean that the entire property does not/ never had planning permission?

    It probably means that whatever was built wasn't in line with the pp which was granted. Have a look at the the previous pp and compare it to the retention application. You may be able to check the old pp online depending on the LA and when it was lodged.

    This could mean alot of things. Iv worked on about 5 hhouses where retention was sought. They all vairedfrom change of size of house to even one where there was a massive fcuk up and the house/perc area where on complete opposite ends of the site lol. You can check the original plans and the retention plans to seee if theres much cahnges. Ive yet to see one not approved for changesn im near sure you can build a house, if no one objects in 7years, you can put in for retention and they hage to legally approv it.

    Just remembed my sister inlaw applied for retention for changes she made to her size windows and also to move the boundry so that when she sells her house so she cant keep half of the 1.5 acre site when she sells her home.

    Found the original PP on-line - looks like there is a difference in the boundry (current boundary is closer to the house) and that there was PP for a garage, which currently is a small wooden shed. The application also states there were 18 conditions - but they're not detailed. Can I check with the CoCo for the details?

    Dont worry to much about the 18 conditions, they are usually sillly things like planting trees the first season, gates to open inwards etc...

    As a follow up question - the notice also states "...A submission or observation in relation to the application may be made to the Authority in writing within a period of 5 weeks from the date of receipt by the Authority of the application..." Does that mean that after the 5 weeks that the permission is granted or do the CoCo also need to approve? If so, any idea how long that might take? Or is that the case of the proverbial piece of string?

    Will the retention application also be viewable on the CoCo website too?

    Retention application will usually be viewable. PP takes 8 weeks unless they look for further information. There is a 4 week period for appeals after this 8 weeks is up.
