Hi can anyone tell me how much Emergency tax i would have to pay on my income in new job . I have given new employer PPs no , but still paying over 35% in tax . Can this be right .

Gross income €390 /€10 per hour @39 hour week .

    Net income €248 for a 39 hour week .

I am told i must do this for 6/8 weeks till i get my tax clearance form . i needed to new new one as the revenue stated my old one expired as i was unemployed over 5 years .

So in summary i am asking , Am i (1) overpaying in tax . (2) when will it be repaid and finally who repays in , is it the revenue or my new employer .

Thank in advance of any help .

Have you asked your local tax office for a certificate of tax credits and informed them of your employer's address details/ PPS number? If not, do so. Once your employer receives your certificate of tax credits and cut-off details from the tax office you will start to receive a refund in your weekly pay.

To check what a normal payslip should look like on that level of pay, you can download my tax calculator Excel spreadsheet - see the link in my signature below (also available on the 'About me' tab of my profile if you're not logged in to Boards)

From reading this , I get the feeling you believe its a given right that you pay emergency tax .

This is not the case . - Emergency tax is just a period of grace in which you are given a set of tax credits , while you await a proper cumulative tax credit certificate .

The quickest way to sort it out is to apply online at www.revenue.ie - and register for paye anytime .

That is more or less what i am asking , do i have to pay as much .
I will be waiting for another 4/5 weeks for the tax credit cert and with only €250 a week pay i cant see myself lasting as i spend 50 on travel and with lunch n stuff i cant afford to live and work on €250 . i know i get it repaid however its now i need it

I dont need to do it online as all the paper work in done and sent away to the revenue both signed by me and employer . i just need to know if my employer is wrong in taking so much before i can go to him and tackle him on it

Your employer is obliged to start you on emergency while you arrange to notify the tax office about your own change in circumstances .

You alone are responsible for your own tax affairs .

No- Your employer collects the tax.

You pay the tax - It is deducted from your gross pay .

    To answer your questions :
    1. Yes- You are overpaing tax
    2. It will be re-paid when you receive a tax credit certificate for 2013 and following years
    3. Your new employer will re-pay to you if you receive this tax credit certificate prior to year end ( Last pay day 2013 )

If you ticked the box for electronic communicationit should only be a few days

check that it has your USC bands against the right emplyer when you get it

What happens if the employer has not payed you back the withheld emergency tax before the year ends, does the employer have to pay it to you in the new year?

Nope you have to claim it from Revenue.

Ok, When can it be claimed and how long does it take generally?

When you get your P60 from your employer (which you should get sometime in January) you can log onto the Revenue website and ask for a p21 balancing statement. This will trigger the refund of your overpayment of tax. In my experience it takes about 5 days to get the refund. Revenue are pretty efficient.

Employer has till 23 February to do the filings that will enable you to claim a refund.
