Unpaid wages - sub contractor

    Im in a situation where Im employed by a recruitment agency -based in the UK - who have paid me once in 6 weeks and have consistently lied about paying wages into my account and are increasingly frustrating to deal with.

    Im sub contracted into another company - based in Ireland - and was wondering if they had any obligation to pay me?

    Any help would be greatly appreciated

    If you want to chase a UK company for money use this official service -> www.moneyclaim.gov.uk

    If you want to chase the Irish company then there are various options. This is too large for small claims court? Needs some kind of legal action, which means it's a load of hassle. The UK system is much more streamlined.

    Thats great thanks. The better option would be the Irish company but Im not sure if they have any obligation as we're employed by the English one and then just sub contracted out

    Do you have a contract with the Recruitment Agency? If so, they normally list the payment conditions & terms - what does your contract state under the payment terms?

    Sometimes, smaller recruitment agencies insert an additional condition stating that they won't pay the contractor until they receive payment from the parent company. Personally, I would insist that this clause be removed before signing a contract - it makes it too easy for dodgy agencies or agencies with cashflow issues to abuse the situation.

    I've encountered your situation twice - in both cases, the contractor told their manager in the Irish company that they had not been paid, and could not afford to work any longer until the agency paid up. A quick call from the manager to the agency sorted things out.

    Thanks, its nothing like that. Irish company has said they paid and English company has never said that they hadnt been paid.
