If the Gardai search your home on foot of a search warrant are they permitted to remove private property of yours that is not given on the warrant as the item(s) being searched for? If for example they take a mobile phone which is yours.

The warrant will usually say that they can take any item they feel is relevant for evidential purposes.

i would imagine the search warrant allows them to search for any evidence.

and they can seize anything that they believe to be evidence of any crime that they find while on any search.
