I fail to understand how RTÉ have gone wrong, which it seems you are implying? (Since you've posted this in AH)

The question you should ask is why are people like this being entertained in the courts?

How on earth can you trademark a name like 'Damo', that is in common usage (especially around Tallaght) ?

Ah here, would you not even mention the reason they're being sued? Or do you like dramatic tabloid thread titles?

How the fvck were RTE supposed to know that some knob jockey would sue over a comedian using the name 'Damo' in a comedy sketch?

    Can you copyright a name?

    Don't know

You can't copyright a drink anyway (thank you Lionel Hutz)

He alleges that the infringement will damage the goodwill he has spent many years trying to build up.

    Wut?

I hope RTE get their expenses paid on this one.

RTE did know but went ahead with broadcasting the show.

Not sure how you can infringe on a trademark for a basic name that hasn't become a ..what do you call those names for things you instantly recognise because they are synonymous with a business or service...trademark.

Nonsense(TM) Anyone who writes nonsense from here on will feel my writ:mad:

Two words for the plaintiff: Get. F***ed.

Think there's been a few similar cases to this in the US before, iirc unless it is a very odd name it has been laughed out time and again. Hope 'The Real Damo' is made to pay the defenses legal bills for this because technically... aren't some of those bills our TV licence money?

Didn't even make it that far to be honest. The first 10 seconds of the autoplay, and about 3 more as I skimmed through the "song" were WAY more than I could have hoped for.

Sorry scratch that... than I wanted.

And by the same reckoning, RTE should have sued joe.ie and Pat Kenny should have sued boards for stealing any variation on a plank theme:rolleyes:

There's no point in suing RTE they don't have any money.

Can I copyright the name 'Bono'? Now that would be a payday:cool:

Damien Rice and Dempsey better be ready to shut their fans up ASAP at concerts if they get the "Damo" chants going.

Good this Ste-o dropped the last bit somewhere in the mid/late 90s then, but that American Stevo chap might have some answering to do (and not just for basically reinventing Shane Richies Don't Forget the Sh!tlycs).

Just saw a clip for it there... looks god awful.

This brand of comedy seems to be all RTE are capable of these days.

There is also a man in Oz who patented 'Burger King' - so they call them Hungry Jacks instead. They've thrown LOADS of money at him down the years, but he just refuses (and it;s not a big chain or anything either).

The cynic in me thinks, his whole extended family (outside of siblings, wife and kids) is just waiting for the day he dies to get the cash cow. :o

Oddly enough, could be coincidental (or just racist mythology) but I did hear a few times there that Aboriginals were the only race in human history to not independently invent the wheel (or at least become accustomed to it way, way, WWWAAAAYYYY back by other ancient civilisations who had).

Ok sounds to me that the 'artist' in question is trying to make a quick buck here. I didn't think you could patent a fictional characters name and the RTE act have been on the telly for many years now...

The writers of the Omen should sue him for using the name of their fictional character as his given name.

    Hey Damien O’Regan

    I'M DAMO!

  • Registered Users, Registered Users 2 Posts: 21,878 ✭✭✭✭dxhound2005

When I was a young fella Damian was always spelled Damian. Poor show by the Irish Times getting his name wrong considering the nature of the case.

    http://www.patentsoffice.ie/eregister/register/TMRegister.aspx?idappli=232533

He has patented Damo but the bit at the end is interesting.

Registration partially revoked following proceedings under Section 51 of the Trade Marks Act, 1996. Partial revocation granted from 23/03/2011 in respect of the following goods and services: Class 9 Computer software; publications in electronic form; sound players and other related apparatus for recording, transmission, storage and reproduction of sound and images. Class 41 Sound recording services; television and radio entertainment services; multimedia radio and television programmes; publishing of books, magazines and other texts on-line.

That doesn't say who initiated the proceeding which led to this partial revokation.

Still you've gotten him a bit of name recognition, ensured we glance at the news on Saturday to see how he got on (extra bit of publicity there) and sneaked in a link to his website without the mods noticing. So its a result really.

I'd imagine it hinges on this aspect
The characters have made live performances, have a noted internet presence and have also released a music album.

If he owns the name for entertainment purposes then he has a case. A bit stupid of RTE frankly, they should have steered well clear of this, it's not as if it's hard to check.
