    Hi can someone direct me to the legislation in use regarding a landowners water rights? Have an issue with a well on our property, used by someone else which needs fixing....

    Good luck! The reason I say that is although the LCLRA 2009 has made land law a lot simpler, there are still many common law and old legislative provisions floating about (please excuse the awful pun.) Starting here may be an option, I'm sorry I can't be of more help but this is a relatively specialist area. You would probably also need access to the various document pertaining to your property and any easements and covenants.

    Try to establish some facts about the use of the well.

    Is there a defined path, gate, stile etc?

    How long has the neighbour or his predecessors in title been using it?

    Anything in your deeds or requisitions on title when your land acquired?
