    Hi all,

    just wondering can anyone shed some light.

    My partner is currently in the process of bringing a cowboy to the SCC for damages to our vehicle. We sent the first letter away and got a response shortly after from the Registrar including a letter from the guilty party who basicly sent a letter of lies and horse mouth.

    We were asked to respond to this, which we have, stating that the response is a total mis truth. We also have witnesses and various other evidenve in the form of phone bills, quotes, pictures etc.

    Just wondering what is the next step for this case as I am unfamiliar with how the SCC works. Is it basicly back and over until the Registrar makes a decision to go to court? Or can the Registrar make a decision based on the replies to one another, even if the cowboy denies his wrong doings. We have basically caught him out in several lies and have put it on paper to the Registrar.

    I myself have zero patience and am anxious as to how long the back and forth will go on before a decision is made :P

    I successfully took a retailer to the SCC a while back. As I recall, there's several rounds of letters go back and forth, where you put your position and the person you're suing gets to reply After a certain point, you'll get a letter saying no agreement has been reached and asking if you want the case to be decided by a judge.

    The whole process took about a year to get to court, if I recall correctly. If it goes to court, you'll be given a date and time for the hearing, but the time is meaningless :- basically that's a date they're hearing SCC cases, there'll be a long list of them, and there's no guarantee of what order the cases will be heard. I arrived at 10:00 AM, and my case was heard about 3:00 PM. So basically it's a day in court.
