Issue with car during warranty

Hi just looking for abit of advice. I bought a convertable at the end of February, after about a month I started having issues with the boot and roof locking down and not working. The garage took my car away to repair on the 2nd April and I didnt get the car back till 27th so a full month. After another few weeks with the weather getting nicer the car broke again with the very same issue. Garage wouldnt help me becauae i was out of warrenty by about 2 weeks. I brought it to an opel garage and they told me that only 2 people are correctly trained by opel to fix these kind of car roofs and the cost is over 1200 euro!! I have been in touch with SIMI but its a very slow process. Just wondering should the garage I bought it from who is a simi garage be held accountable to fix my roof since the issue is ongoing since before the warrenty is up and because they had my car for a month and were not helpfull during that month.

If the roof was repaired in the warranty period and then broke again, outside the warranty period, then I don't see the issue. Its outside a generous warranty period. Its just poor luck. You have to draw the line somewhere and if they are willing to 'good will' over two weeks, why not two months or two years? You have to call it somewhere.

If the roof broke again, inside the warranty period, then its a different story.

i would be inclined to say it looks like teh same issue and as it was requested to be fixed under warranty it shoudl have been fixed, and stands that they are still liable?

I mean are you saying that you buy a car with a 3 month warranty and get a problem after a month, garage holds car for 2 months sends it back to you, says its fixed, and when you find its not says, sorry your out of warranty. that cant be ok...

Ye i get that but the main issue is i dont think the roof was fixed the first time just a temperary fix to keep it going till the warranty ran out since the mechanic he used had the car for over a month and it broke again with the very same issue less than a month after i got it back.

I wouldn't expect the SIMI to come to your rescue anyway. They are pretty useless as far as the customer is concerned and are only self serving.

I would imagine that the first repair was not done correctly.

Small claims court costs you €6 and payout I think the limit is €1250
Its amazing how often the threat of the small claims sorts them out
Small claims court the judges really don't like these scams of keeping things until the warranty is nearly out before giving it back.
Forget the SIMI lark they are there paid by the motor i industry to waste your time to keep you from going to small claims until ~6 months has passed and reduce your chance to win in the courts

Maybe try the National Consumer Agency (nca.ie).

I'd agree but it may be difficult proving it.

I'd imagine it doesn't really matter on the Astra TwinTop, it's just going to break again.

Boss's wife had one, and I've lost count of the number of times it's been with us to drop it to Opel. As her Father used to be an Opel dealer, and the Boss used to be a service manager in an Opel dealership, they both know the right people to talk to about this, but it's still back every few months for the same issue.

    Minor correction:
Fee is €25 and max claim is €2,000.
