refused pp again

    hi all, i am very heavy hearted having been refused planning permission yet again. this time its because of 2 reasons, one i can over come the other is because of the shape of site, yes the shape of the site. it is large enough and has the road frontage required but goes back into a field and around (as i cannot go through my brothers field.) all feels very unfair. so here comes the question..

    1 - has anyone ever heard of site shape being a reason for refusal on a rural site?
    2 - can i go to ABP and appeal one of the reasons for refusal? i know this is very unusual, however, you can appeal a decision, you can appeal a condition, why not a reason for refusal.

    advice appreciated.

    1. Yes I have seen that before. There are minimum site areas prescribed so that standards are met. if your site is am amalgamation of areas joined by thin strips then in reality, those standards are probably not met.

    2. You can appeal the decision, but you'd be referring to the reasons for refusal and include in your appeal how you can overcome one of the reasons. You'd still be appealing the decision.

    the area of the site is a very reasonable size, almost 2 acres. the house is placed on 3/4 of an acre with a 40m wide strip around the brothers to another acre. i feel really hard done by here.
    i wanted to appeal a singular reason for refusal rather than the whole decision as i can over come one but obviously cant really change shape of site. i m really scared that if i appeal the decision total, that they may add other reason for refusal which will be thrown back in my face if i re apply.

    Hi. Planning has elapsed, due to health reasons did not build. Now being told that we don't meet the criteria for living and working in area although plans to move and live there. Foundations have been down prior to planning expiring. Would love some advice please. Thanks

    Technically It is exempt only if the criteria of Schedule 2 Part 1 Section 8 are met.
    Basically for no more than 9 months in a year, occupied as a dwelling or used for business use. Satisfy yourself from the regs to be sure
