Fraud or Genuine

    I bought an iPhone 5 for 370 through paypal off a guy on adverts.ie
    He told me that(most of the talking was done through pm)he posted the phone via standard post on Friday evening at around 4.40-5.00pm
    Monday came-no delivery
    Tuesday came- I got money delivered from a guy who I was selling a game, he told me he posted the money out on Sat..! so I was amazed if this guy posted late and it arrived on Tuesday and the phone, who the seller posted a day before still did not arrive ...!??!
    So I asked the guy what is the story? yesterday around 1.00pm
    He told me that he will go to the post office at 4 and see...
    He came back and gave me a call saying that the post office told him because he delivered on Friday, nearly the closing time of the post office the delivery van with the post had already went, so the phone got posted out Monday morning and that it should arrive def today..
    Today came... no phone, post man went to other people's houses... asked him anything for me and he said no.
    So I called him and he said he will go to the post office again today same time 4pm and ask and if nothing can be solved he will refund my money, he even told me and insisted that I should wait another day!!!
    So I want to know is he playing the fraud, has he even sent out the post or does he just want to waste my time.
    And what should I do ? :confused:

    Did he give you tracking number ? Postage in Ireland takes a no more then 2 days.

    As you paid with PayPal you're under their buyer protection. If open a dispute if he didn't send you a tracking number.

    I kept asking him for a tracking number but he would not reply, but that is because he said he left his mobile phone at home and he was at work, the next day I asked him if he could give me the tracking number, he said he had lost the receipt and he could not find it so later on I decided asking him did you sent it out by registered post or standard he said that, he was going to sent out by registered post but he ran out of money so only can do standard, and with standard there is no way of tracking, altough he was a good amount of good feedback on adverts.ie
    and I cannot raise a dispute until Friday, but in the other hand he says that he will refund money today or tomorrow after he goes to the post office in the evening
