    So stopped at lights yesterday and got whacked hard from behind...very apologetic guy seemed very genuine. Unfortunately for him my car was only a year old yesterday so its going to Audi to be repaired/assessed and I imagine it could be expensive.

    Looked undamaged but rear bumper actually has a big crack(or what looks like one), assessment is this morning.

    Would you give the guy the option to pay himself or just leave it with insurance? Both parties same insurance company if that makes a diff. I really just want no hassle and my car back in shape asap.

    Its a year old and an Audi, leave it with the insurance companies. It's going to be expensive ;)

    yeh...unfortunately for the guy thats what i reckoned too..when it just looked like scratches on the paintwork i reckoned expensive...and then when realised the crack when i got home...i feel sorry for the guy as luckily xray was clear for me, so its just car, but expensive im sure. (head was sideways looking for gap at the time so got a fair shake out of it, but I'll live so all grand)

    Just leave it to the insurance company. Make sure you ask about them about providing you with a replacement car while yours is being repaired. These things happen and really to cut down on the hassle for yourself just hand it over to the insurance company.

    Leave it with the insurance companies. He mightn't have any interest in paying himself anyway - I certainly wouldn't.

    just saw that its already on my statement of insurance that I "made a claim" and I have to pay first 250€..just what I needed as I shelled out 250€ for xray and doctor, etc yesterday already...So €500 effectively out of pocket before even looking at car...this is getting to be a real pain in the ass already!!!!!!!!!!

    yeah but keep all your reciepts and you can claim them and any other expenses from the other party.

    Im guessing you were being sarcastic ;) But anyway was sore yesterday..but xray just showed inflammation not sore today so i guess its ok. they reckoned it would be worse today but...meh..

    Not encouraging anyone to take personal injury claims but if it's only 24 hours you need to leave it a week or so before deciding you're fine. It's likely to hurt more today than it did yesterday.

    Agreed, but whiplash damage can take much longer to appear.

    Make sure you make it clear to your insurance company that you are not claiming under the comprehensive section of your Policy but you are claiming as a Third Party under the person who hit you Policy. As others have said keep all your receipts and send them into the claim handler who is looking after the matter.

    Makes no odds really.

    If the claim is being made via the OP's insurer then it's a COMP claim but with a view to recovering the outlay.

    OP, your insurer should be pursuing the other insurer for your excess along with their outlay when it's all done and dusted. It's an uninsured loss but generally the comp insurer just asks for a cheque for €250 in your name too.

    As for any other costs, call his insurer and ask to be reimbursed or even seen if your own insurer would throw this in with their outlay request (unlikely)

    the other party is with AXA also. total cost looks like 1400€ for repairs and medicals. But yes I have to pay the first 250€ and claim it all back I guess. And yes I am claiming from his insurance not from mine. Hmm I will call AXA to make sure of that

    If you're being charged an excess then it's going through your policy.

    Call AXA and tell them to vet it through his policy as you don't "feel" like being out of pocket and by rights, you really shouldn't be put out of pocket.

    How right you were!!! They had it as an open claim on my policy and on his policy AND they had registered the actual repairs and bills on my policy!!!!!!!

    Just spoke to them and they said it was a mistake and they are closing the claim on mine and gave me a new ref number for the bills....And they said as my medical bills were 255 then I don't need to pay the garage anything as i am already out by 250 excess for the moment, they will repay me.

    The guy will have the option to reimburse AXA anyway. It's important to ALWAYS notify your insurer of any accident, regardless of blame. It can get messy, even when the other guy is so nice.

    I was rear ended a couple of years ago and it was a rough smack too. Knocked the car forward a couple of feet. Handbrake was on. I was looking forward and the head support saved me from a more serious injury. I ended up with whiplash from the motion of my head going forward when the car stopped. The burning pain was instant, like someone had put a hot spatula against the back of my neck. Sounds like you got very lucky OP. Your car is heavier than mine, so made a difference no doubt.

    to be honest yes i was lucky its a big heavy car..as it was a hard hit and my head was sideways and forward at the time, slip road going left and trying to watch for a gap in traffic. Automatic gearbox in D at the time but with the auto hold on so I guess that held pretty well, car just jostled forward. Was dizzy for a few mins but pain is pretty much gone already it feels like thankfully...am hoping it doesnt come back!!

    Oh and some REALLY helpful a$$hole came up to us just after the incident and says to the other guy "i saw everything, you barely touched him, here's my number.." I mean seriously....the bumper has a massive crack, and I have a (thankfully minor it seems at the moment) neck strain...but he saw everything he said!!!!

    dont know that....AXA got me to bring it to their place for assesment, you think I need to go to Audi also? The AXA place just looked at the bumper, didnt take anything off or move anything, it was up on a lift but he just visually looked at it (suit guy, not mechanic) and said it was just bumper..

    Now I am worried...

    Get it checked by a place you trust, not affiliated with the insurer you both have. They made enough mistakes already!

    Just be aware op that whiplash is most likely to appear on day3 after impact .

    I'd be wanting more then a visual inspection tbh, especially with an autobox in the equation. Im sure its fine, and nothing to worry about, but better to be safe imo

    just called audi and they want 150 quid to run diagnostic...they think its very unlikely to have any damage unless its making a noise, said to drive it for next week (repair to be done next Tuesday) and if anything happens to bring it in to them, but its unlikely to be damaged...will see how the week pans out so..thanks for the heads up.

    I was also in an auto when rear ended. It was in "N" and hand brake was on. No damage, but I would imagine that there might be damage if you were in "P". (I can already see the jokes)

    I know it doesn't matter but I read this thread with an AXA advert running in the bottom of the screen.

    OP I would have the auto box checked, my brothers q7 was ran into from behind and it damaged the transmission and diff, but that was with quattro involved.

    well I have been to Audi now and they said they will take care of everything. To quote the guy there "next time you hear from me it will be all agreed and I will be getting you to bring it in" and they will loan me a 132 reg while mine is in :D

    insurance company tried to put me off saying they wouldn't cover a replacement car unless i used their service...etc...

    Examine the car carefully when you get it back, in my experience main dealers are not great at bodywork.

    That's fine if the job is done properly, less so if a substandard repair becomes a problem come resale. To put this in perspective, it once took Maxwell Motors in Blackrock four attempts to repaint a rear bumper on a two month old E90 for me before getting it right. Receipts won't help if the back of the car is a different shade form the front.
