Car Problem

    Looking for some advice. Bought a car from a SIMI dealer two months ago. 2010 Reg with full main dealer service history. 6 month full warranty came with car. To cut a long story short the engine is now a write off following an issue with some injector seals that ended up seizing the engine. Two main dealers have advised the engine needs to be replaced but the garage I bought from(not main dealer) has said he wants to try and fix it and if he can’t fix it he wants to put the engine from a similar mileage crashed car into it. The main dealers were recommending a new engine not one from a crashed car. The dealer assures me if he gets an engine from a crashed car it will be in perfect condition or he will not put it in.

    At this stage I don't want the car back as I will not have the car I bought. I’m potentially storing up problems and when it comes to selling the car in the future as I will have to tell potential buyers it has a replacement engine which will be a huge negative selling point and to be honest I will always be driving with a bit of fear as to what is under the bonnet.

    I was offered a car with more mileage and a partial refund which I don't want to do as the mileage is too excessive. We have been unable to agree a price on car with similar or lower mileage as I think compared to market rates he is asking too much and potentially factoring some of the repair cost in this.

    What are my options?

    1) Is a refund and return of the car I initially in traded in possible?
    2) Do I have to accept the repair he does on the car even if two main dealers say it can’t be repaired and needs replacing?
    3) Do I have to accept a second hand engine in the car?
    4) As per sales of goods act is a low mileage car with a perfect ahead of time service history of merchantable quality. The incident happened 4,000 miles after last service.

    If it's 2010 reg is it not still under the manufacturer's warranty?

    For a second hand car dealer he sounds pretty bloody reasonable in all honesty!

    Manafacturer warranty is expired by 3 months and despite efforts they won't do the repair under goodwill.

    Not saying he is being unreasonable just want to know the position and my options. Thanks

    The legalities of second hand cars are tricky at best and the charter precludes legal advice. Have you had a ready of the motors and Consumer Issues forum, just a suggestion, hopefully someone can be more helpful.

    Not legal advice but you won't get option 1 without going to court. The dealer has offered a repair and a replacement so it'll be tough to fight for a straight refund.

    2) main dealers are out to sell new parts. Plenty of Insurance write offs, where the quote is done with main dealer labour and new parts, are put back on the road in a near perfect condition with 2nd hand parts. If you do go for the 2nd hand engine get a good written warranty for at least 12 months on it.

    3) No, but you're back to the reasons why option 1 will be tough.

    4) Engines blow. The fact that it had a main dealer service and was only 3 months out of factory warranty which they won't honour sets alarm bells ringing in my mind, google your car and the issue.

    Thanks for feedback , engine appears to be reliable which I thought would work in my favour re goodwill submission. Because it went out of main dealer network for the sale they will not honour goodwill even though no one other than Mazda mechanics have ever touched this engine.

    there is no reason why a second hand engine is not a good option. the Dealers will only fit new parts that is why they are telling you only to fit a new engine. What mazda is it and what engine has it got?

    Mazda 6 TS2 2.2TDi 163Bhp.
