No NCT on car, is the driver responsible?

    Ok, long story short, my car is in the car hospital and I got a lend of a friends car. I'm covered by my insurance and there is tax on it.

    However, NCT was up in mid feb. The car is booked in to be tested again in sept.

    If I'm stopped and the Garda that stops me feels like issuing me a fine/penalty points, am I responsible or is the owner?

    I don't want them getting stuck with a fine when they're doing me a favour.

    Mods, gonna put this in legal but if ye feel motors or somewhere else is a better place for it feel free to move it, thanks.

    18.—(1) A person shall not use in a public place a mechanically propelled vehicle to which this section applies unless at that time there is in force in respect of the vehicle a test certificate.

    (2) Where a person contravenes subsection (1) of this section, he and, if he is not the owner of the vehicle, such owner shall each be guilty of an offence and shall be liable on summary conviction to a fine not exceeding fifty pounds or, at the discretion of the court, to imprisonment for any term not exceeding three months or to both such fine and such imprisonment.
