    In fairness, a drunk man points a gun at the police what do you expect. That is if the police are telling the truth.

    Can't really blame the cops at this one. they have a caller telling them 'man with a gun', they show up and he immediately points what appears to be a gun at them as soon as they show up to see what's up, any cop who is interested in going home to his family that night isn't going to be wasting much time asking him to kindly put the gun away.

    One seconds hesitation could lead to a dead cop, if you're stuipd enough to point a gun, replica, toy gun or something that looks like a gun at police you're gonna get shot.

    WTF?
    He wasn't drunk or anything. He was holding a pistol grip lawn watering hose when a neighbour reported him as drunk with gun.
    The cops just shot him without warning.
    I see this news is going viral for some reason but the original news was in 2010.

    Doug Zerby was killed by Long Beach police and after a day of deliberations, a jury found police officers violated the civil rights of a man who was shot and killed without warning, awarding his family $6.5 million in damages.

    Apologies for the fact that it was 2010 it popped up in my RSS today. As joe said above if the cops turn up to a situation where they have been informed that a man was holding a gun and then they get the "gun" was pointed at them they are likely to shoot. Should the neighbor who made the call be liable for damages?

    I see the settlement was reached in April this year so maybe that's why it's becoming news again.

    No, I don't think the neighbour can be blamed for anything, to them it may may looked like the real thing over a distance.

    The blame in my view lies with the police failing to recognise what was going on.
    It's not the first time either. It's even worse if the guy is black.

    The michael moore clip is irrelevant. The police showed up to a call where they had been informed a gun was in use. They are going to prepare for the worst and when they arrive on the scene the guy aims at them with both arms in a shooting position with an object that looks very like a small gun, which was evidenced in the call. Of course he was going to get shot. Now maybe the cops got their story together and said he aimed at them but thats a different story altogether.
