can you get a car that has been left in your space

    A car has been abandoned in my apartment space for 4 days. Its out of tax since May. It hasnt been moved since Friday night/ Saturday morn when they stole my spot! Its not a carpark that is monitored by a clamping company so despite leaving a note, it is just ignored. I am in someone elses spot which I hate doing but I have no other option.

    Also there is no management company, and landlord doesn't know Car owner. What can I do? Can I get it towed by a towing company? Should I? Im at risk myself seeing as now I am in someone elses spot!!

    Should I call Gardai seeing as technically its abandoned and out of tax?

    Can anyone suggest anything?

    Council won't take cars from private property.

    So I should give the Gardai a call so? I assume Gardai will contact the owner?

    This happened to me before.

    I called the Guards and they told me there was nothing they could do. But you've an advantage with the expired tax situtation. So I'd definitely would give them a call.

    If nobody is interested and the car is open you could push it somewhere else.

    Although it could very well be stolen and abandoned.

    Is it anything interesting? Lots of people post here about stolen cars so they may be interested. Could be worth posting a picture.

    There is not requirement for tax on private property, for instance a driveway or anywhere outside public road (for a parked car).

    Could be all very innocent. Not fair to go pulling the car apart at this early stage.

    If that car parking spot comes with the apartment then it is up to your landlord to get it sorted for you. If you are paying rent for an apartment with a car parking spot then that is what the landlord has to provide. Get your landlord to sort it out!

    Probably is a bit early but keep it in mind. From experience, Gardai won't do anything even if it is out of date. Worth keeping in mind so. My experience didn't involve a car on private property though.

    You could make a complaint to the Gardai.

    I would suggest that if you decide to do this, that you take photos of the car in your space, and bring some written evidence that the space is yours (lease, car parking agreement/licence, or whatever).

    If you arrive down to the local Garda station, it is possible that you may get an initial standard response along the lines that it is a civil matter and that you should see a solicitor.

    However, I would suggest that you print off this section (which amended the Public Order Act 1994) and show it them.

    You can explain how this car being parked in your space has caused you great inconvenience, and that you believe that whoever parked the car has committed an offence under the Public Order Act.

    Then you could ask them very nicely if they will agree to tow the car away.

    If you don't get the response that you need when you make your initial complaint, you could write to the local Garda Superintendent.

    So Gardai referred me to Landlord to ensure they had no clamping/towing company agreements. Turns out though it is out if tax and is not insured, also registered in county other side of country! Garda thinks it may be abandoned, not registered as stolen but they referred to carpark as private so their hands tied at moment.

    The Landlord will be calling to Gardai tomorrow as carpark can be construed as having public access 8am - 6pm, so I think he might be able to get them to remove it on that basis.

    BTW Its not a bad looking car.
    I won't tamper with it or numberplates.

    Hopefully there will be resolution tomorrow! I will let you know.

    Now that's very interesting; obviously designed to apply where someone is present on the land but they can be given an instruction to remove the object, which is good.

    I found three dodge non nationals at the Car late yesterday. I read them the riot act and told them the Gardai were aware of the car and the issue of no tax or insurance. They were actually v apologetic, I dont think they expected such a stern reprimand from a girl!

    Car moved now. Thanks for replies and info
