    Well heres the story.....

Swaped my Golf for this Bora Monday >> http://cars.donedeal.ie/cars-for-sale/vw-bora/5133895 . Anyways I had a few problems when he came to view...my oil feed pipe on turbo came loose so had to get it fixed went to a mechanic in Gort, He's my cousins, cousin and he fixed that anyways he had her up on the lift ect and the boys who had the Bora seen him playing with her and well had a real thorough look at the car...she was on a lift like ?? Anyways they were happy with it and we swaped cars, I gave €160 his way and that was that ! Anyways anyone who knows my yoke or read my thread I had problems with the car and spent big €€€€€€ getting her right and I came with my folder or receipts €1000+ ,,,The car was 110% and I will stand by this !
He took off anyways giving the car welly and I had a gut feeling he was going to roast her and I knew the turbo (Being only new) might not take the abuse because my own mechanic and Sasha Auto said to take it handy for first few months (4-5 months) and I have ! Now he called me yesterday roaring the turbo was gone which I relly couldnt believe and I asked him numerous times did he roast her and did he allow turbo to cool down and I knew by his reaction he hadnt and I explained to him what my mechanic had told me that you must let it heat up and cool down for at least a year ect...! Now today he called and said mechanic had told him Engine was bust, turbo was bust and so was injectors..!! Now my heart sank lads not for the dirty p**ck that bought the car but the car itself and all they money I had put into it...its really f**kin eatting me alive anyways he was shouting and roaring on phone F this and F you ect..I told that couldnt be possible after al the recnt work being done to car and that I was sorry but I said to him he must have roasted her to which he replied "You F'in screwed me, I want my own car back" I replied then that it was private sale and that he couldnt, He seen her on a lift for f**k sake what else did he want ?? He even had an heavy vehicle diesel mechanic with him !!
He then threatened me by saying "I'm not going to send the log book for bora away" now I still have Golfs log book aswell in fact I was buying stamps to send it away when he called !! I got onto my local Guard and told him the story he wasnt to sure what to do but said he would get back to me and I was onto the Mechanic who worked on the car he said he wasnt to sure either so I really not sure what to do but Ill be onto solictor tomorrow I think explain situation but from the oppinion of the Guard and Local Mechanic yer man hasnt the ground to stand on and to explain to him that the car was 110% and that theres not much I can do about it, sold as scene !
Guard also said he would write up a report ect....for me if I have to go to court same as my Mechanic !! Also just incase ye think my Mechanic did a balls of the car he's possibly the most repected mechanic in Connemara! Yer man said hes going to solictor because apparntly my car is 110bhp and I advertised it as a 130bhp which was lies....now anyone how knows there Golfs will tell you that you cant get 110bhp in 2003 Golfs, 110bhp Golfs are not six speed ect...more than likely she was broght in as 110bhp for cheaper Vrt....I also told him that ! Nowww tired afta writin that and I could f**king strangel the c**t for ruing lovely Golf and for trying to f**k me about by refusing to send log book ?? Anyone know what else I should do ect...??

Any help appreciated lads I was 110% honest with the lad like why is he doing this ??

I think the only way forward is with a solicitor.

First off, clam down. Do you still have a copy of you ad to prove you sold it as 110bhp and 5 speed? You have witness to prove he inspected the car and receipts and mechanics reports to show the car was in good working order.

Next time he rings, be clam and explain this to him. Also say that you will be taken legal advise and not to contact you directly again, your solicitor will be in contact with him. Check with a solicitor before you send the Golf VLC off.

Remember gather all proof you have for getting the car in good order and the ad you placed, your solicitor will need this.

    Let him off.

He's wasting his time. All moot, nothing slam dunk.

The only true meaningful value in this, if any, is nuisance value.

On top of that, I don't think we can or should be doing legal advice on this forum.

Cool the heels, let it blow over for a few days. Then address it. Ultimately, I wouldn't be getting too worried or tangled up in it.

Tell him to contact you in future through his solicitor.

Anyone in my experience that threatens legal action never goes ahead with it so I wouldn't worry about him.

Guards said wait until his solicitor sends a letter to me,,then go to my socilitor ?? Also car just passed NCT month ago.....Also I removed my ad off Donedeal when I had it sold as you do ?? Cant get that info but have got all the other Ads I placed in Adverts, Vagdrivers, ToyotaownersIrl and Autostadt !! Is that anygood ?? Car was down on logbook as 110bhp but he seen that because he signed logbook,, all 2003 golfs are 130bhp ?? She was down as GTTDI on log book aswell ?? Anything else I should do ??

Ok lads...im trying to stay calm but the fact that he has refused to send on log book is worrying ?? What can I d about that ??Car is no good without log book ?? Sent mine off today the one beloning to Golf ??!

Boards cannot provide legal advice so I have removed that from your title.
You should speak to a solicitor. Do you have a receipt for the purchase?

  • Registered Users, Registered Users 2 Posts: 23,901 ✭✭✭✭ted1

You could have advertised the card as having 10,000 bhp and it wouldn't legally make a difference to the sale.

Lithe main lesson here is to ensure that the logbook is dropped on the post before you leave or leave with it.

Your main issue is getting the ownership transferred.

Someone may be able to advise you of how to do that although I suspect it will involve solicitors

You have said enough to him.
Ignore any more texts or calls from him.

    Solicitors..

Did you get the Bora checked out. If he's that unsympathetic to your old car what's the Bora like? Then you may have some fire to fight back with..

They need the other person to post off the VLC for the Bora they got, so they can't ignore him.

I would ignore him. Its not immediately an issue that you dont have title. Sold as seen no guarantees were given. Id send off tbe transfer of ownership for yours if I were you. Then its just a case of him not holding up his side.

He would be better off leaving this to his solicitor, imo.

The golf is in his name now or soon will be so it's his problem.

Regarding the bora why not just rack up a few speeding tickets and parking fines and he'll not be long signing it over.

Possession is 9/10th of the law, you have the car. Contact your solicitor and don't lose sleep over it.

This, remind him of this and it might get pinky and the brain operating in his head.

Just to add a further point. Seeing as you two swapped cars I'd hazard a guess he hasn't got a lot of spare cash. So the chances of him paying a solicitor to chase you are slim.

I wouldn't pin all my hopes on this, but it is something to consider.

In my short time studying law he has no come back on that.

If you live near the M50, take this route a few times; he'll be sending the logbook to you fairly lively!

He's full if it and has no come back. Get your solicitor to write a letter demanding he send of the VLC. If he refuses then apply for replacement documents for the car.

There is a way of looking at sold done deal ads, i've often clicked on old done deal links on facebook, they redirect you to donedeal.co.uk, when you put an ad as sold for some reason they transfer it to that domain with a big red SOLD stamp across the ad, it's impossible to search from the website but try googling as much of what you had down on the ad as you can remember(word for word, space for space), if that fails try contacting done deal, i'm sure they could help. btw there's technically no such thing as a mk4 110bhp golf, it's 110ps (108bhp) it's prob something simular with the 130 and 150.
