Hi, my 3 year old (2nd hand uk import, just out of warranty) car just died:mad: it will prob cost about 10k to repair/replace the engine..what are my options if any re compensation...do I go back to the dealer, the distributor, or my insurance company? I have fully comp insurance, and a full service history for the car...

    cheers, daithi

What car is it? even a new engine shouldn't cost 10k, unless it's a high performance one.

You won't get anything from the comp insurance, that's for accidents.
If it's out of warranty, you may be looking for some good will on the part of the dealer/manufacturer.

The car in question is a 2010 Mazda 6 2,2l td TS Sport. I had an issue about 5 weeks ago with carbon build up in the sump, which I was told had been rectified. The oil pressure light came on yesterday and the engine became very rough, tractor sounding..I pulled in and got the car towed to a Mazda garage only to be told today that the engine needs to be rebuilt-a a leak in the fuel injection system caused air to get in thereby carbonising the oil, this in turn caused the sump to become rapidly blocked and no oil to get into the engine. The engine then seized up and the drive shaft has failed ...there had been numerous cases of fuel injection system failure documented in mazdas, the garage said it is not a problem associated with my driving, and would not be picked up unless you stripped the engine down, which they have done. my problem is now, who pays for any further work?...

OP, the insurance is unlikely to cover it but please tell us who you are insured with and if it's fully comp. or not. You're definitely not covered if you have less than fully comp.

This is in the RSA policy document, it's probably a typical disclaimer...

The Insurer shall not be liable for

    a) loss of use depreciation wear and tear mechanical, electrical, electronic or computer failures or breakdowns or breakages

Mechanical failure isn't covered by any insurer.

I'd be going after Mazda to be honest. If she's well serviced you could have a case to argue..

If its just out of warranty and it has a full history and if its a common issue, then mazda really should be looking after the most part of this.
Dealer might not be helpful when you bought elsewhere but you could always ring a northern ireland dealer quoting your chassis number and see if there is any help available.

What work had you done 5 weeks ago. Is there any chance they f*cked up the oil pickup if they had the sump off or something like that?

The oil pressure light had started to flash, so we went straight to our nearest garage with the car. they told us that there was a carbon buildup in the sump, causing the oil pressure to fall below 1 bar. they then took out the sump, cleaned it of the carbon and refitted it-the measured oil pressure thereafter was 5 .0bar and back to normal.
We had been driving the car as ususal right up until the car died on me on tues morning..
    thanks for any input,btw.

Id be towing the car out of that garage and to someone else. You should be able to pick up an engine from a breakers in the UK for it for under 1.5k and 500 should cover fitting. Thats just the risk of owning anything mechanical but Id be limiting the losses.

If I understand correctly, this garage performed a repair that possibly resulted in engine failure 5 weeks later? Was it a Mazda garage? Did you pay for the work? And most importantly, can it be shown that the current situation is as a direct result of their work?

Hi it cost me about 4k to get the engine replaced..fingers crossed, have had no issues since then, and it's still a lovely car to drive...i''l probably drive this car until it dies of old age(hopefully) as its resale value is probably zilch now. It seems that all the newer diesel cars seem to have issues with dpf and/or timing belts, so look carefully.....
