Work related accident..

    Hypothetically if somebody was in work tripped over a raised step in work, they hurt their foot then went to the hospital but there was nothing detected in the x-ray of the foot at the time but the person had constant pain in the foot since then. A bit of time elapsed and now has discovered than the foot was in fact badly damaged and may need operation but lets say the previous owners have sold the business to a new company. Is there cause for law suit?

    Was the employer negligent?
