Possible Flight Tax Refund

Hi, just wondering if anyone has any advice.

Last September I booked a return flight to Australia (leaving in September and returning in April), I wasn't fully sure of my exact return date so the date in April was rough enough. I didn't book with the airline directly but with an agency (I did a search on Skyscanner.ie and went with the agency with the cheapest flights that suited me).

I checked the terms and conditions of the flight and it mentioned a 175euro fee to change return dates plus any additional charges due to fares and taxes. There was a 35euro fee I could pay on booking that gave me ""Free amendment of the itinerary or passenger names".

In November though I had to fly home but when I contacted the agency they quoted me a flight and a fee that was more than a brand new one way ticket plus the 175e mentioned above. The reason given was

"our original return flight was scheduled for April 2013, however, the same flights are not available in November. In this case, we came in contact with the airline in order to find alternative flights for the preferred dates. The airline informed us that the original flights had an advanced purchase fare, which is no longer available on these flights and the only way is to reprice your ticket."

The 35euro that gave me ""Free amendment of the itinerary or passenger names" was only valid with the agency seemingly and not the airline.

It made no sense to book this new flight as I could get it cheaper myself, which I did. I then enquired about getting a possible refund or any taxes back to which the response was

"Please note that according to the airline, since the outbound leg (fare and taxes) have been used, you are not entitled to any refund."

I kind of left it then but I've been told recently that the above may not be fully true.

Does anyone know if it is? Or has any advice.
