Late tax return fine

    Hello. I was recently informed I had a rebate due to me ( I'm a self employed contractor ). In order to receive it, I would have to resubmit returns for two previous years that I never did. All taxes for that year were paid, however, and I had nothing to claim for - I owed nothing, and was owed nothing.

    After submitting the returns for those years ( both for zero ), I was promptly fined for late submission for quite a considerable amount, one which I cannot afford to pay unless they just give themselves the rebate they were going to give me.

    Is there anything I can do in this situation ? It was my own wrong assumption that once taxes were paid in full, and I didn't have to claim for anything, that I did not have to make a return.

    You could try to appeal the late filing penalty. You may or may not be successful based on your circumstances.

    Resubmit, I assume you mean submit for the first time. If you owed nothing then there should be no surcharge as the surcharge if 10% of the liability. If you owed 10k and had paid 10k in prelim tax then its not correct to say you had no liability, the surcharge is 1k, it's a self assessment system and I can't imagine them waiving the surcharge because you don't know how the system works.

    Who told you that you were due a refund, and how did they know if you hadn't filed tax returns?
