gary doyle order

    I am due in court next week, it will be my third appearance, on the first day my solicitor applied for statements to be issued from the Gardaí, and the judge said something about a Gary Doyle Order. On the second day in court, my solicitor applied for a hearing date, as he was told he had the statements. To date my solicitor still has not received the statements from the Gardaí. What can I expect on my next day in court, can we ask for the statements again.

    It's really something for you to discuss with your solicitor. I'd imagine he'll have trouble claiming he has no statments if he has already said he had them. Also, statments are not always available. If it's a minor offence such as public order there may not be a Garda statement.

    Thanks for that. What I should have said was that the gardai handed over an envelope on the morning of the court to the Solicitor, about 5 mins before the case was to start. So the Solicitor asked for a date for hearing. On opening the envelope after the court we discovered that it was just the custody records and a copy of the Garda's note book. Do these quantify as statements?

    That depends on the alleged offence.

    Thanks it was just that I was told by a friend that as I was contesting the case and that a gary doyle order had been made, we were entitled to the statements from the Gardaí and witness that they were intending to call.

    Only if a statement had been taken though.
