Summons for Speeding

    I was caught doing 70km in a 60km area and I received a fine in the post in my girllfriends name as it was her car. I went to pay the fine but was told I must get the name changed first so we filled out a form requesting to change name and sent it of, I received nothing for months and then I received a summons saying I did not pay fine and I must go to court, do I have any come back?? and if the Garda who caught me speeding is not there will it be struck out?

    Did you get proof of posting the form.? Otherwise its your word against theirs, and no prizes for guessing on which side the outcome will fall.

    The summons in his name is proof that he posted the form, the question is whether he received the fine in his name.;)

    OP - Go to court, cross your fingers, explain what happened.

    Just say you never received the amended fine and that as you had already changed the name you were clearly willing to make payment.

    hang on, if a Gard caught you speeding the initial fine would be in your name. Only if it was a camera van would the fine come in your gf name.

    I think the OP is assuming it was a garda that caught him speeding when it probably was a go safe van or unmanned speed camera.

    OP go to the Garda station as soon as you can and explain yourself. If you can, see if you can talk to whoever you were talking to the last time (did you get their name and number).

    Not much point as this stage as its above station level. The fine was issued by a camera van as there is no way a Garda who stopped you would issue a fine to the owner of the car rather than the driver at the time. As such it really has nothing to do with the station, the fines are centrally issued from Templemore I believe.

    I'd get your facts all together and compassionately plead your case. You'd want to have some way of proving that you attempted to change the name on the fine i.e. Registered post back to fine issuing office. Simply attending a Garda station is in no way proof that you attempted to pay a fine. If that was the case you could just pop in and then throw the letter out on your way out the door, claiming it was later lost in the post.

    Why people don't pay for registered post in these instances is beyond me.

    Explain the situation,

    Failing that, plead it out in court, with evidence (names times etc) of attempts made to rectify the matter.
