Historical and Future Development of Irish Commercial Law

    Hi to everyone again. Currently trying to tackle this question:

    In light of the historical development of commercial law, what are the major influences on the future development of Irish commercial law?

    Struggling to come up with any sort of a structure...the only thing I can think of is to highlight how earlier pieces of legislation have gradually been amended by EU directives and law...was also thinking that maybe things like competition and copyright would be most likely to influence future development, given that they are so topical?

    Would either of these be remotely correct? Thanks for any help!

    How about: The transition from a laizze-faire approach that valued freedom of contract to a more regulatory approach with a general emphasis on good faith and the relative strengths of parties bargaining power.

    Insurance is a good example. The attraction of common law from an international point of view is that, unlike some civil law jurisdictions, there is no general duty of good faith in contract law. However, in Ireland post-Manor Park Homes the balance may have shifted decisively. Only time will tell if this is the start of a re-balancing of the scales or whether it will be overlooked and left to fall by the wayside.
