Small Claims Court

    Having submitted my complaint, I have been told by the registrar that I have a valid case.

    Is it a requirement for me to be present when the case is being heard? I'm in Leinster and court in Munster I work 5 days per wk so might not be able to get free time to attend.

    Yes. You need to be there to present your case to the judge. You may also be questioned during the hearing.

    It may be possible to have someone else represent you. The small claims court is quite casual. A lot depends on the type defence being run

    You're better off going in person, the chances are if its a large company or organisation you're taking on they won't have anyone there in court, so the judge will automatically find against them, especially if you've gone to the trouble of showing up....
