I finished with one company 2nd week Dec and started new job 1st week Jan. Who is responsible for my p60? My previous firm said its not up to them?

As you weren't in employment on 31 December, you don't get a p60 for the year. Previous employer must give you a p45

as you finished with the company in mid december you will get a p45 and not a p60 from them. you only get a p60 if you are still employed with the company at the end of the year
