Parking in an estate - public or private?

    Hey,
    Just wondering what deems an estate private, such that a resident can demand that you do not park in their estate (or in this case, the entrance to the estate)?

    I've been parking in a spot for a few weeks and today a man told me that it's a private estate and I can't park there. There's no signage to mark same, no gate - it's just a cul de sac estate that's close enough to the town and my car is parked about 5 meters away from the 'main' road.

    I told him that as far as I'm concerned it's public and that I can park there.

    If the council haven't taken it on its private
    I'd they have its public
    Are there lines on the road? Is it new or unfinished

    From your description it's not private property according to the Road Traffic Act.

    That's not what the OP is asking, Tigger has provided the correct answer.

    While it's open to the public with vehicles, the car park of a shopping centre is a 'public place' for the purposes of the RTA but it's still private property and they can regulate parking according to whatever rules they decide.

    Once the council takes over maintenance of the road in an estate then it's in public ownership and the council alone can set the rules for parking.

    However in most such enclosed (no through road) estates there's usually a self-appointed parking warden who will put out cones, bolllards, wooden tubs etc. to stop the public from parking there, he's happy for the taxpayer to pay to maintain the tarmac but doesn't want them parking there. The OP has clearly encountered such a species in this estate.

    It's an old enough estate, probably 20+ years just going by the houses. I did read that the council have to 'take on' a development some stage after completion, so I assume they have done so by now. But even still, is there anything that could make it private?

    On the opposite side of the road to where I park there's a single yellow line. A double yellow line from the main road stops about 2 metres in to the estate, just beyond which being where I park.

    Never park at an entrance to any estate, you could create a blind spot and cause an accident.

    he's 5 metres in, that's over two car lengths and he's beyond the double yellows, I think he's OK from a road safety point of view. If there is no signage, they need to provide some if they don't want you there OP

    edit..maybe not two car lengths, I don't know what a metre is cos i'm old...

    All depends on the construction of the entrance, IMO 5m is not adequate.

    I'm certain I'm far back enough for it not to cause a blind spot but I'll make sure to park even further back from now on though just in case, cheers.

    Its not private. You just in countered a busy body. Its happened to me where some one thinks they own the road outside or near their home. If you legally parked your ok.

    I'd find another place to park as the busy body probably has a lot of time on his hands - you would be wondering what he may be planning to do to discourage you from parkingthere! probably start by sticking notes on your car and so on- not worth the hassle.........
