Construction Regs

    Hi looking for some help as regards the construction regs for an assignment i am doing. I know you don t have to inform the hsa and appoint project supervisors and other criteria if the job is less than 30 working days or 500 man days. But my question is if the job is less than 30 days does that mean the construction regs are not applicable. For example in my assignment where an employee was injured on a construction job if that job was less than 30 days does that mean the regs don t apply and so i could not state his employer was in breach of the construction regs. Thanks any help/advice would be greatly appreciated.

    • The mother and father of em all is the Safety Health and Welfare @ Work act 2005 and the employer is liable for his/her employee's there with or without the construction regs.
    • If you look at the start of the 2006 regs you will see a definition of a construction site so whether your work is notifiable or not it will mostly fall under the remit of the regs, under the 2006 regs the employer would most likely fall under the category of Contractor, or a Contractor in charge of a construction site.
    • Also just because the work is not over the said 30 working days or 500 man days, it may contain a "particular risk" which also makes it notifiable and if you fall under the remit of a client, PSDP's and PSCS's are appointable.
    • Depending on how exactly the accident happened there are several other bits of legislation that cover different areas of construction.

    The Health and Safety Authority have a lot of guidance documents published on the Welfare @ Work act 2005 & the 2006 regs, you will also find codes of practice on there that will explain the legislation further.
