Legal question about a website

    I'm in the very early stages of setting up a Last Man Standing website (similar to Paddy Powers game). People can either play for free or pay a yearly subscription fee to subscribe to the website. Those who subscribe will get a number of additional features, the main one being able to enter a number of competitions throughout the year to win prizes.

    Do I need a gambling license? Or would it even be considered gambling? Or does the fact that people are only paying to subscribe to the website rather that paying directly to enter the games mean it wouldnt be an issue.

    Maybe this forum isnt the correct place to get my question answered. If not does anyone know who I should contact?

    Short answer, which hopefully won't be considered to fall under the banner of advice: If you plan on giving out prizes, you need a solicitor to check your position. If you don't plan on giving out prizes, you don't need to worry about licences.

    Remember though that if you're taking in subscriptions, you must account for it with the tax man. And given the nature of the site, it may be worth your while setting up a limited company to ensure maximum protection.

    Yes I will be giving out prizes on the website. is there an authorities/organisations I should talk to or would an solicitor be able to provide the information I need?

    As for receiving payments, yes I intend to account for it with the tax man. I want my site to be 100% legitimate! And I hadnt considered setting up as a limited company but since you mentioned it I'll definitely look into this option.

    You'll definitely want to set up as a Limited Company, and a venture such as this will probably need legal advice generally. see a solicitor.

    As you guys suggested I sought legal advice as to whether or not I would need a gaming licence. Unfortunately the solicitor I spoke to wasn't able to answer all of my queries as they didn't have the expertise in this area. I'd like to avoid another wasted visit to a solicitor so maybe someone here would know of a solicitor(s) who might be able to help me or specialise in the area of licencing. If you are not allowed to post names of solicitors will you PM me? Also, I can travel so location wont be an issue!

    Tell your solicitor to get an opinion from a barrister in the area, (pretty much most solicitors would have to in this case).
