Buying a used car

    If you buy a used car it's up the previous owner to send the documents off.

    Does this mean that you had over payment and get no documents as proof?
    What's to stop some knacker just not sending off the documents and pocketing your money?

    You have to sign it also.
    You could ask for a receipt, but generally you just sign it and they send it off.

    What's stopping a seller to get replacement VRC and report a car stolen?

    That's pretty much a solution.
    I like UK way as well, where buyer get a small slip from registartion cert as confirmation that he actually purchased a vehicle.

    What about contract of sale.
    Something like:

    I, John X am selling a vehicle reg. no 05D12345, VIN number XXJFD30893239, mileage 120k, to Michael Y for the amount of 3000 euros.

    Signed and dates in two copies for each party.

    Would this have any more legal value?

    I've never met a seller that wasn't ok with writing a receipt for the money.
    Then again, if I suspect the seller to be dodgy I just don't buy the car.

    ive sold 3 cars and all times the buyers tursted me to send off the VLC. was in my interest to do it.

    But still when buyer doesn't get any receipt from seller - and most buyers don't - there buyer has no proof of his beneficial ownership.

    And if there is a doubt who is beneficial ownership, then most likely it's going to be the person who has registered ownership.

    I have never bought a new car, all the cars I have ever bought have been bought from private sellers and one or two from dealers. I've owned 30+ cars and never had a problem with the seller not sending off the tax book. There have been instances where I have insisted on getting the registration cert from the seller or I wasn't buying and theyve always handed then over even though they're not obliged to but I guess getting the car sold is more important to them. I, on the other hand insist I send off the registration cert for any cars I sell. I have had buyers threatening not to buy if I didn't give them the book but I've called their bluff and said fine and go to walk away from the deal but they change their attitude and let me send off the book which I do immediately afterwards as I don't want the car in my name once it's gone.

    Same thing has happened to me. A buyer tried a fast one but I didn't budge.
    God knows what happens if you let them away with the log book.

    "If this" and "if that" and if my aunt had balls she'd be my uncle.

    In a dispute over beneficial ownership of a vehicle, irrespective of the bits of paper, only a court can resolve the issue. The courts will use the bits of paper, if any, in resolving the dispute. End of.

    Always the same type of ridiculous arguments - "but this" and "if that" or "but in other countries" or "if they were spaceships it would be different" or "I seen it on Coronation St/The Sun/The Star/The Our Boys ...".

    Only a fool would pay out hundreds but more likely thousands and not get a signed receipt detailing exactly what they had just purchased.

    I don't really get your point here.

    Current situation where seller and buyer signs back of logbook which stays with seller to be posted, makes an open door for scammers that can sell a car, and report it stolen.
    Without any paperwork buyer has nothing to prove that he bought the car instead of stealing it.
    What ifs are your talking about?
