Is an employer obliged to give a P45 if employee only works there for a short time?

    Hi there,

    I would appreciate some help, I worked in a supermarket last year from mid September to November.

    I never gave them my p45 when I started as I had another job at the time too.

    I would like to know if this employer is obliged to give me a p45 now? as I want to get a balancing statement for 2012 and no details of this job are coming up with Revenue.

    once you have had one pay period processed by the employer, he is obliged to give you a P45 on finishing work.

    While you didn't give him a P45 at commencement did you at least give in your PPS number for him to get your tax credits, or did you inform revenue that you were now working for this employer. Did you get payslips for the period you were working there?

    yes I was getting pay slips while working there and I was getting emergency taxed while I was there (I didnt inform the revenue I was working there) thought I would be able to claim the tax back once the tax year ended but the revenue have no details of my employment there.

    So just want to make sure that they have to give me a p45 before going back to them.

    its possible that revenue haven't got up to date yet with employer's P35s which the employer is obliged to file by 15th Feb every year, and that could be why there is nothing showing. If you have difficulties getting the P45, you can still contact Revenue and at least with the payslips you have proof that you were working and paying tax there. Its also possible your old employer just forgot to give you the P45 too so phone up and request it.
