New Work Contract ????

Just gotthis email from the recruitment agency I work for, Seems a bit odd to send thisat 9pm in the evening and want a decision by Friday, or am I just being paranoid????Any advice would be greatly appreciated.

*=+/Recruitment is in the process of offering the opportunity to apply forpermanent contracts to both current temporary employees and new applicants, fora new service called PermForce.

The newpermanent contracts do not change your current assignment location (i.e. theclient site to which you are assigned) and are based on the opportunityprovided by recent legislative changes and which ended the situation whereemployees of recruitment companies could only be employed on temporary employeecontracts, irrespective of service or assignments worked on.

This inturn created some disadvantages when for example a temporary agency employeeseeking a mortgage or a loan was required to supply a letter from their employerdemonstrating that they were in permanent employment in order to progress theirapplication.

Althoughthis will not change for employees that remain on temporary contracts, successful applicants for permanent contracts with +*/= Recruitment will forthe first time enjoy the benefits which accrue to permanent employees, as theywould with any other employer. Indeed, some of the uncertainty on agencyworking will no longer apply and other benefits include:

[*]Your employment is no longer based on assignment with any one client
[*]You will be paid between assignments (50% of last pay for up to 8 weeks)
[*]You will be redeployed immediately as assignments end, or be paid either way

This hasbecome possible since the introduction of the Protection of Employees (TemporaryAgency Work) Act 2012. The effect of such a change would be that you wouldbecome a full-time direct employee of *+/= recruitment, removing the uncertainnature of temporary employment.

You wouldbe employed as a general operative and it would be our responsibility to ensurethat you had continuous employment as a general operative. This guarantee isnot specific to any one location or client contract. However it is ourintention to phase out the current arrangement at +++==++ and replace our workplacemodel with only ‘PermForce’ contracted employees.

Please beadvised that the nature of this contract means that only +*/= Recruitment, asyour direct employer, will determine your terms and conditions and theprovisions under the Protection of Employees (Temporary Agency Work) Act 2012covering pay will not apply to your contract. This of course does not affectyour other statutory rights and entitlements under employment law and contractlaw.

Theclosing date for applications is 5pm this Friday 15th March and applicationsare by email only

You should talk to a solicitor. Most of the advice here will be people's opinions which may be worthless or misleading.
