I am changing the CEM in my 2001 Volvo S40. Once I get another one with the same part number, should it be compatible with my car? Or is it possible it is programmed differently? I see a few on ebay with the same number.

Just a Q: are you sure it's a faulty CEM?
Afaik, if the one you get is for a identical car setup (for instance both have fog lights and rear wiper) there's no need to reprogram it. It should be plug and play but if you get issues with certain functions there may be a need to program those in the new cem.

Fairly certain. One of my dipped lights doesn't come on intermittently. A bang where the CEM is often gets it working.

Yeah, classic cem issue with the headlight.
You could try re-soldering but perhaps a replacement is easier.
