    Hello all ..quick question on holiday pay . Am i entitled to receive holiday this year from last year if I didn't take any holidays at all last year ? In full time employment .

    Your employer has broken the law if you didnt receive AL. However, it's possible your employer operates an annual leave year which differs to calendar year, and besides there are provisions which allow employees to carry AL forward.

    So, yes, you should be able to take your AL entitlement from last year. You should not get paid in lieu, which is against the law unless leaving employment.

    I know the onus is on your employer to ensure you took AL, however you had to have been aware you were hoarding AL!

    This seems to be a bit vaguely defined. All the links I've seen that people have posted before have said that the employee is entitled to x amount of leave, and the employer must give the employee the opportunity to take it (or words to that effect).

    I don't know if it's actually stated anywhere that an employer must force someone to take leave if they've not used it (and haven't been refused leave). Hopefully someone can post a link that does say it, and clear it all up!

    Obviously it's not good management to allow that to happen, but it does.

    Colash, you didn't use one day's leave? I'd never last a year like that! Your boss never spoke to you about it?

    No i didn't take one day off . It's hard to get a defintive answer from my employer to be honest . All our contact is over the phone . I didn't take any days leave during 2012 . An I asked him can I get what I'm owed from 2012 in holiday pay an he said he would look into it
