Planning Due Date

    Hi,

I was wondering if anybody could give me any advice on this. We applied for planning permission 8 weeks ago and the due date to get our answer was 23rd February (yesterday) but we have not heard from the council yet. I have heard very different stories from different people saying that if it goes past the date that it means it has been granted does anybody know if this is true? I have heard that if it goes past the date that they automatically have to give it to you or maybe if it was sent by registered post Friday 22nd and it comes Monday (25th) that they are covered. Maybe none of this is true but just wondering if this might be a good sign that we have not heard yet.
    Thanks.

Have you checked online with the relevant local authority's website?

Yeah I checked and the application status just says pending?

So long as they can show that they made and sent the decision (by registered post) within the statutory 8 week period (add another 9 working days over Xmas period if applicable) then all is good. If not then you can look for permission by default.

Thank You! Any ideas if this might be a good sign? I know people who have gotten refusals before due date and a few that were granted and were not notified until a few days after?

Most registered post within Ireland is next working day delivery or 2 days at most unless there's no one there to sign for it.

Really and truly there are no pointers until you open the envelope. You are, as the applicant, entitled to phone them tomorrow morning and ask what the decision is/was in the event your post doesn't get delivered until late in the day or whatever :)

Well you were right about now knowing until you open the envelope haha! Got refused :-( and apparently have to wait 4 weeks before we can re-apply and 8 weeks for an answer again. Grrrr.... This is one looooong process but fingers crossed for next time!! :-) Thanks!
