Clearly individual charges on a given deed may lead this to vary from case to case but, in the absence of any other agreement, is there any particular legislation/precedent that determines who must maintain a piece of land that someone has a right of way over? Does maintenance fall to the owner, or the user, or both and…

Clearly individual charges on a given deed may lead this to vary from case to case but, in the absence of any other agreement, is there any particular legislation/precedent that determines who must maintain a piece of land that someone has a right of way over? Does maintenance fall to the owner, or the user, or both and are either restricted from taking maintenance into their own hands?
