    I have been getting mixed advice regarding this so hopefully someone here can give me a proper answer. I went to FLAC and it was useless, he didn't listen to what I was saying and kept going on about maintenance.

    Father of my child and myself have no set arrangement in place for when he sees the child as he works random hours, so he takes her when he can. (More so when he wants actually).

    However this can mean that he will go for weeks without a visit and then insist on taking her at inappropriate times etc. which I can no longer deal with. It's not fair on the child either.

    So my question is can an access order be applied for by the resident parent in relation to the non resident parent. All advice online is about the non resident parent seeking access but in this case it is just me wanting to have it formally set out.

    He wont make an arrangement with me outside of court to make a rule of court. Also how would all this work with not having exact times etc. due to his work? Like he can't say he'll take her every saturday or whatever.

    If you can't afford a solicitor the legal aid board will provide one, current waiting times 6 months.

    But the simple answer is yes you can seek any order re access you wish, set times or days overnights or not. While the court will listen to you and your ex and if necessary the child, the court will order what it believes is in the child's best interest.
