urologist short-changed by almost €34,000 by estate agent

    The Circuit Civil Court heard that Professor Fitzpatrick, of Brighton Road, Foxrock, Dublin, had been short changed by almost €34,000 in rentals due from an apartment he had bought in 2004.

    He told his counsel, Stephen Dowling, that the apartment in Barrow Street, Dublin, had been financed by Anglo Irish Bank and rental arrangements with an agency recommended by the bank had worked well for the first four years.

    In 2008 he had entered into a letting agreement directly with David Fox, of Rathmines Road, Dublin, and also with Fox Property Let Ltd., Lower Main Street, Lucan, whereby rentals collected by the agent were credited to him.
    INTERNATIONALLY-FAMED consultant urologist John Fitzpatrick was today granted judgment for €33,846 against estate agent David Fox and Fox Property Let Ltd.

    Professor Fitzpatrick told Mr Dowling that in November 2009 Mr Fox had secured tenancies with three students, one of whom had collected and paid rental to Mr Fox.

    Mr Dowling told Judge Matthew Deery that when the lead student had checked back on her bank accounts she discovered she had paid Fox more than €20,000 rent on behalf of herself and her friends.

    Professor Fitzpatrick said far less than that amount had been paid to him after which Mr Fox had given him 12 post dated cheques all of which bar two had been met. Overall there was an outstanding debt of more than €33,000.

    Judge Deery directed that judgment of €33,846:26 and costs be entered against Fox and also against his company.
