    Hello all,
Im in the process of buying a Husaberg fe390 thats not 12 months old yet. Will I have to pay more vrt because its still under 12 months. Also what will the inspection involve when I take it to the NCT centre... will all the road trim have to back on the bike as it will be used for off road use only. The reason I want it road legal is I travel some roads to link the green lanes and dont want issues with the local Guards.

    Thanks in advance,

    Gereen.

Think is the vehicle is under six months old, then you also have to pay VAT!!

Have a look here and here to get an idea of prices and next steps.

Also check if it's got less than 6k km's, as if it does VAT is also due.

    http://www.revenue.ie/en/tax/vat/faqs/private3.html

For bikes the inspection involves checking the frame number, mileage etc. and only takes a few mins.

But this is the crazy thing about the bike it will probably never do 6K klm in its life its for Enduro and off-road use with the occasional road section between green lanes.... Where do I go from here ? The NCT are too stupid to try to explain the story to as I have done this before with another similar bike that was 3 years old but only had 900 kms on it..

He tried to wind the odometer back on his Dad's ferrari. I think Lomb is saying wind it forwards

Colm thye bike im going buying has road trim such as indicators and mirrors which has been removed to prevent them for braking and getting snagged on undergrowth also to make the bike as light as possible...will these have to be put back on the bike for the NCT to pass it ?

    No.
The Logbook it comes with should be sufficient.
The NCT don't test bikes, only cars.

    welcome to Ireland:)

It's an EU law actually, not a unique Irish one......

What I don't understand is this: Having paid VAT in one EU state, why then do you have to pay VAT again in another if the vehicle is under 6 months old? Import tax I can understand (even if I don't agree with it), but to pay another 23% again is daylight robbery!

With no trim/indicators etc the garda will have a field day regardless of it having plates etc..

Can't you claim the original vat bak in that case?

AFAIK I don't think so, but stand to be corrected. I know that you can't claim back VAT on good bought in the EU in the UK, and I would assume it would be the case here.

Not necessarily, there is no requirement other than having a head and brake/ taillight and number plate lights and a red reflector.
Once the bike is taxed and insured its all good.
No garda is going to try a prosecution if you are compliant.

Because an EU regulation came in to stop people buying "new" stuff in one state, parking it for 6 months to make it "used" and then importing it with reduced taxes into another State as a secondhand vehicle. In fact, iirc, one of our own MEP's took a case to court over this many years ago over a Mercedes bought (in Brussels, I assume....). The mileage & age requirement is an attempt to make truly 'used' vehicles exactly that - actually used. Imagine the mayhem possible for vehicles bought in Luxembourg (lowest VAT rate) and, say, Belgium, 60 seconds across the border. It was't just good ol' Oireland they were thinking of !

If you have to pay VAT here, and you have already paid VAT elsewhere in the EU, yes you can claim back VAT from the authority at point-of-purchase within the EU. You should only ever end up paying VAT once.

I bought a car in the UK and paid VAT there. Now I am asked to pay VAT in Ireland. Why?
VAT is payable in the State on registration where a vehicle is less than 6 months old or has less than 6,000 kilometres on the clock at the time of registration. However, in these circumstances, any VAT paid in the UK may be refunded on application to the appropriate UK VAT authority.
