Uk retailer problem

    I've got a problem with a uk retailer at the moment, Id like to hear some other views on it.

    I bought an electrical car part (€120) in September via ebay, fitted it to my car and about 3 weeks later it stopped working. I contacted the retailer on ebay about the problem and they said to call them, upon calling them they were adamant I must have water damaged the item (bear in mind it was inside the car and in no way on earth was it possible) they eventually agreed to check it if I returned it.

    I returned it to them and they again claimed water damage and said it wasn't there fault, so I tried to open a paypal dispute but it had gone over 45 days and wouldnt let me. The retailer was just fobbing me off so I contacted my credit card company and they said to forward them all the details ect and they would look into it.

    Fast forward to the start of the month and my credit card company said they tried to make contact with the retailer and gave them 30 days to reply but they didnt, so they were processing a chargeback for me (in the meantime the retailer also sent me back the broken item)

    So the chargeback went through against paypal, who in turn charged back the retailer, but in the meantime paypal opened there own investigation to see if they could dispute with the credit card company on behalf of the seller, after a week they decided against and closed in my favour.

    This is when the problem starts, the retailer then emailed me seeking the full amount and accusing me of fraud/theft/lies what not and that they were going for a small claims judgement against me for the money back, plenty of bullying emails on their behalf saying they would drag me to court used ect ect so I contacted my cc company and their response was to send the item back again by reg post and ignore all further contact with the seller.

    Here's where it gets fishy, I sent the item back and it came up delivered and signed for, but a day later this changed on the royal mail website to no answer at address,and now appears to be back in ireland in the returns section in roscommon as the return address wasn't complete. It appears that they signed for it, saw what it was and then popped it back in the post somehow as a return.

    To throw another spanner into the works, I used parcel motel to initially have the item delivered, if I take my CC advice and ignore all correspondence, I could end up with a euro small claims judgement against me, on the other hand there's the hassle of topping up my PM account just to receive the letters to begin with so its like a cache22

    Anyone like to throw in there 2c as how best to deal with them?

    Oh man... Wow

    It sounds like they're just butt hurt about being out of pocket and are bullying you into repaying them.

    If you could get a letter of confirmation from both the CC company and PayPal it would really help if this ended up in the small claims court.

    A company cannot take a small claims court action against a private individual and even if they could take other action, no court in europe would find in their favour as both the bank and paypal found in your favour already.

    Ignore their stupidity.

    I was under the impression a European small claim could be taken against a private individual
    The procedure will apply in civil and commercial matters where the value of a claim does not exceed EU 2000.

    From their last correspondence and them sending the item back again I'm presuming their trying to claim that I have an item that I haven't paid for. They were pig ignorant to try and communicate with so I wouldn't be surprised if they do try and go ahead with it
