Ann leave and public hol pay

    Hi just looking for some advice , I am contracted 20 hours per week , my working week is normally 3 days, however for the last few years I had been working 3-6 days per week, every week is different , some weeks it's 20 hours other weeks 35 -42 hours. When I take Annual leave I am paid 20 hours As contracted. Should I be receiving extra holidays for extra hours worked,
    Also my contract states I am entitled to 20 days annual leave but I only get 12 as I would expect is normal for a 3 day week ,
    For public holiday which fall on a non working day I was paid 45 mins pay, when I contacted wages dept I was told I only work 3 days so this is correct ,

    I have questioned the above with management and been told its the way it is for part time staff working over 3 days , however I am contracted 20 hours , no mention of over how many days with a holiday entitlement of 20 days according to my contract ,

    Are you 100% certain there is no reference in your contract to holidays being on a pro-rata basis? As in 20 days per year pro-rata?

    If not and your contract states 20 days then they are duty bound to honour the contract. It is probably a mistake as it is 20 days statutory leave for full time workers and usually pro-rata of this for part timers (most common method of calculating it is 8% of actual hours worked up to the statutory minimum).

    If your contract says 20 days then you would have a strong basis for ensuring your contract is honoured.

    8% of your worked hours with a cap at 20 full days.
