3 Day Week extra day work

    Hi All,

    I have been on a 3 day week for the last 3 months. My employer wants me to work 4 days next week. This may happen again in the future.

    He wants to give me a days holidays for it. I would prefer to get payment for working the day. Does anyone know if I am entitled to pay rather than taking an extra days hols ?

    If it is on an ad-hoc basis then they can offer you a day's paid holiday. It's called time off in lieu. You will need to check your contract to see where you stand on this. But it is effectively the same thing - work 4 days this week, get your normal week's wages for 3 days, then take the additional day at a later stage, work 2 days but get paid for 3. It is effectively the same thing. The employer might just be doing it this way to make things simpler for payroll, or perhaps they don't have the money to pay you, or perhaps they want to make it clear that this is not part of a new working arrangement, but additional hours.

    To the best of my knowledge you are not entitled to pay if your contract allows for TOIL. If you are contracted to be paid per hour then you may be entitled to be paid for each hour you work.

    Either way, whatever the final decision is - pay or extra leave - make sure you get it in writing. Otherwise you might find yourself having to argue for the extra time off in 6 mths when your employer has forgotton all about the verbal agreement you made.

    Finally, as a part time worker, the extra hours you work also count towards your total AL accrual (8% of total hours worked to a maximum of 20 days) so the more hours you get, the more leave you get. So it kinda works to your advantage as you will get 8% of your hours that day (so if you do an 8 hour day that is about half an hour leave on top of the extra day paid leave).
